Kick-Out Clause

A clause letting a seller keep marketing their home and accept a better offer, even while under contract with you.

In plain English

A kick-out clause is common when a buyer's offer is contingent on selling their current home — it lets the seller continue accepting other offers and "kick out" the contingent buyer if they can't remove the contingency within a set notice period.
