Dual Agency

When one agent (or brokerage) represents both the buyer and seller in the same transaction.

In plain English

Dual agency happens when the same agent — or two agents from the same brokerage — represents both sides of a sale. It's legal in many states with disclosure and consent, but the agent can no longer fully advocate for either side individually.

Why it matters

If you're offered dual agency, you can typically decline and bring in your own independent buyer's agent instead, at no extra cost to you.
